A 3(16) fiduciary partners with plan sponsors to maintain regulatory compliance with laws such as the Employee Retirement Income Security Act of 1974 (ERISA) and other regulations issued by the IRS, DOL and Department of Treasury. A 3(16) plan administrator can you avoid the most common mistakes plan sponsors make. Consider adding a 3(16) plan administrator to serve as a co-fiduciary to your plan.

ERISA is a federal law that covers certain standards for employer-sponsored retirement plans and regulations for plan fiduciaries. A plan sponsor is a named fiduciary of the retirement plan under ERISA, either by title, specific designation or by maintaining certain responsibilities. ERISA requires plan sponsors who are fiduciaries to adhere to ERISA’s principles of conduct and several annual administration duties, including (but not limited to):

  • Delivery of required eligible employee/participant notices and plan terms
  • Upload payroll contributions
  • Provide accurate year-end census date
  • Execution of all documents, distributions, Forms 5500s, and more
  • In addition to a 3(16) administrator serving as a co-fiduciary, a third-party administrator (TPA) can take the lead in translating and communicating new regulatory guidance in a way a plan sponsor can understand, giving them the opportunity to focus on operating the business.

Plan Participants

If you have a retirement plan at a previous employer, you may be able to rollover the balance to a new plan.

Hardship, in-service withdrawals and/or loans may be available if you are an eligible plan participant. Ask your employer’s plan sponsor for the required forms and return the completed form to them. Your employer’s plan sponsor will submit the form for processing. Some withdrawals take about 10-15 business days for processing.

Check with your employer’s plan sponsor and verify your plan’s recordkeeper. If Definiti is the recordkeeper, you can change your contribution amount and check your account balance online.
